Moonpark is an inclusive platform made for connecting in person. Our mission is to get people away from their phones and build connections offline, and one of the fundamental parts of building a community is to make sure everyone feels safe and protected. This is why we believe in being transparent about how we use your information.
This Privacy Policy (“Privacy Policy”) describes how moonpark (referred to herein as “we,” “us,” or “moonpark”) process personal information collected through the app. We may update our policies at any time and additional terms may be added depending on your region. By continuing to use this platform, you consent to any updates to our Privacy Policy. This version of Privacy Policy supersedes all earlier versions, so we encourage you to review this document frequently and to remain informed about any changes.
IMPORTANT SUPPLEMENTAL INFORMATION
Outside of the United States. If you reside outside of the United States, such as in the European Economic Area (“EEA”) visit our “Outside of the United States” supplemental section at the end of this Privacy Policy for additional terms and privacy information that applies to you.
California and Vermont. If you reside in California or Vermont, visit our “California and Vermont” supplemental section at the end of this Privacy Policy to learn about specific privacy information that applies to you.
1. Definition
Undefined terms in this Privacy Policy have the same definition as in our Terms & Conditions (“Terms & Conditions”).
2. Information We Collect
2.1 Information necessary to use the moonpark platform. Users may access the moonpark platform without providing any personal data. However, in order to create and/or sign up for Classes on the platform, some or all of the following information will be required:
- Contact and Profile Information. Including your first name, last name, phone number, email address, date of birth, country, city, and gender. You will also be asked to create a user handle and password upon registration.
- Payment Information. You will be asked to link your bank account to Stripe in order to host and/or book a Class.
2.2 Optional Information. You can choose to provide us with additional optional personal information, including:
- Additional Profile Information. Including pronouns, language(s) known, biography, profile photo, and information about how you learned about the platform. A survey will also be conducted at the beginning of registration in order to provide the best recommendations.
- Additional Information for Guides. When users sign up to be a Guide, an additional survey will appear with questions about teaching style, teaching experiences, preferences, and more.
2.3 Automatically Collected Information. When you use our platform, we may automatically collect information including:
- Geo-location Information. Moonpark uses your mobile device’s GPS in order to recommend classes within your vicinity. This can be enabled or disabled at any time through your mobile device’s settings or permissions. We may also collect this information when you’re not using the app if you enable this through your settings or device permissions.
- Usage Information. Such as the content you viewed, searches, bookings you have made, and other actions performed on our app.
- Log Data and Device Information. Such as details about how you’ve used our platform, IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, and cookie data. This information may be collected even if you have not logged in or created an account.
- Cookies and Similar Technologies.
- Payment Transaction Information. Such as payment instrument used, date and time, payment amount, payment instrument expiration date and billing postcode, email address, IBAN information, your address, and other related transaction details.
2.4 Personal Information from Third Parties. Moonpark collects personal information from other sources, including the following:
- Third-Party Services. If you link, connect, or log in to the moonpark platform through a third-party service (e.g., Google, Facebook, Apple), you agree to permit that third-party service to send us your information (such as name, email, etc.) as authorized by that service and/or by you via your privacy setting at that service.
- Background Information. For moonpark users in the United States, to the extent permitted by applicable laws, we may obtain reports from public records of criminal convictions or sex offender registrations. For moonpark users outside of the United States, to the extent permitted by applicable laws and with your consent where required, we may obtain the local version of police, background, or registered sex offender checks. We may use your information, including your full name and date of birth, to obtain such reports.
- Referrals. If you refer another user to our platform or class, we may collect data from your referral link, including your name, email address, and other personal information.
- Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as references, demographic data, or information to help detect fraud and safety issues from third-party service providers, and/or partners, and combine it with information we have about you. For example, we may receive background check results or fraud warnings from identity verification service providers for use in our fraud prevention and risk assessment efforts. We may receive information about you and your activities on and off the moonpark platform, or about your experiences and interactions from our partners. We may receive health information, including but not limited to health information related to contagious diseases.
3. How We Use Your Information. Moonpark uses your data for the sole purpose of improving our platform and marketing, providing payment services, and creating better, safer experiences for our users. This includes, and is not limited to, sending notifications and promotional messages, enabling users to make and receive payments, allowing users to communicate with one another, providing recommendations for classes, and performing analytics and research of the platform. Unless otherwise stated, we will not sell, rent, or disclose any of your information to any third party.
4. Sharing & Disclosure
4.1 Public Information. By using the platform, you agree that certain public information will be visible to other users, including your first name, last initial, profile photo, and city. When you book a class, you agree to have the Guide view your public information and contact you through moonpark’s messaging function or through your personal contact information as to details of the class.
4.2 Public Information for Guides. When you list a class on our platform, you acknowledge that details of the class are publicly visible to other users, including the approximate or precise location, time, pricing, and description of the class. Additional information that you shared (e.g. self-rating, biography, etc.), as well as reviews from other users, will be visible. By posting a class on the platform, you also agree to have other users contact you through our messaging function.
4.3 Compliance with Law. You acknowledge and agree that moonpark may disclose your information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to: (a) comply with a current judicial proceeding, a court order, or legal process served on us or our website, (b) enforce moonpark’s Terms & Conditions and policies, (c) respond to claims that your information violates the rights of third parties; (d) protect the rights, property, or personal safety of moonpark, its employees, users, and the public; or (e) enable the transfer or sale to another entity of all or substantially all of our stock or assets, or upon any other corporate reorganization, subject to the promises made in this Terms & Conditions document. We also may disclose any information about you to law enforcement or other government officials as we, in our sole and absolute discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or that we believe may expose us or you to legal liability.
4.4 Analyzing your Communications. We may review, scan, or analyze your communications on the moonpark platform for reasons outlined in the “How We Use Information We Collect” section of this policy, including fraud prevention, risk assessment, regulatory compliance, investigation, product development, research, analytics, enforcing our Terms of Service, and customer support purposes. For example, as part of our fraud prevention efforts, we scan and analyze messages to mask contact information and references to other sites. In some cases, we may also scan, review, or analyze messages to debug, improve, and expand product offerings. We use automated methods where reasonably possible. Occasionally we may need to manually review communications, such as for fraud investigations and customer support, or to assess and improve the functionality of these automated tools. We will not review, scan, or analyze your messaging communications to send third-party marketing messages to you and we will not sell reviews or analyses of these communications.
5. Third-Party Partners & Integrations
Moonpark may link to third-party services such as Google Maps/Earth and Stripe. These services are not owned or controlled by moonpark, and we are not responsible or liable for the information you provide to these services when interacting with them. The use of these services is subject to the privacy policies of those providers.
6. Your Rights
6.1 Managing Your Information. Some personal information (e.g., last name, etc.) can be updated through the setting, and it is your responsibility to ensure that the information you provide is accurate and up to date. If you have linked or connected a third-party account (e.g., Facebook or Google) to your moonpark account, you may unlink the accounts at any time for any reason through settings or by contacting moonpark or those third parties.
6.2 Data Access and Portability. In certain jurisdictions, you have the right to request and receive copies of your personal information or information about how we handle your personal information, request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format, and/or request that we transmit this information to another service provider (where technically feasible). Moonpark will honor any such request.
6.3 Data Erasure. In certain jurisdictions, you have the right to request that your personal information be deleted. moonpark will honor all such requests, but please note that if you request the erasure of your personal information:
- We may retain your personal information as necessary for our legitimate business interests, such as prevention of money laundering, fraud detection and prevention, and enhancing safety.
- We may retain and use your personal information to the extent necessary to comply with our legal obligations.
- Information you have shared with others (e.g., reviews, etc.) will continue to be publicly visible on moonpark even after your account is suspended, terminated, or canceled. However, attribution of such information to you will be removed. Some copies of your information (e.g., log records) will remain in our database but are disassociated from personal identifiers.
- Because we take measures to protect data from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period of time.
7. Security
While no enterprise can guarantee complete security, moonpark strives to continuously implement and update new measures to help protect your information against unauthorized access, loss, destruction, or alteration.
8. Amendments to Privacy Policy
Moonpark reserves the right to update our policies at any time and for any reason. Notifications on any material amendment will be sent to your email, and by continuing our services, you are consenting to any amendments to our Privacy Policy.
9. Disclosure; Violations
By registering on moonpark, you are agreeing that you have read and understood the Privacy Policy and consent to all of the terms listed in this document.

10. Outside the United States Supplement
APPLICATION
This section applies if you reside outside the United States and supplements our Privacy Policy.
Moonpark does not currently operate within Europe and the EEA, and moonpark does not intend for its services to be used by persons located within Europe and the EEA. Nonetheless, this section contains information we may be required by the General Data Protection Regulation (“GDPR”) to disclose. If you have any questions, you can contact us at hello@moonpark.haus.
WHO IS THE CONTROLLER OF YOUR PERSONAL INFORMATION
Where this section mentions “moonpark,” “we,” “us,” or “our,” it refers to the moonpark corporate entity identified in the moonpark Terms & Conditions, which is the controller of personal information submitted to moonpark, and can be contacted at hello@moonpark.haus.
LEGAL BASES FOR PROCESSING PERSONAL INFORMATION
Moonpark processes personal information for the purposes described in the Privacy Policy in line with the lawful bases set forth therein. For more information on the processing activities, please refer to the relevant section of the Privacy Policy.
DATA ACCESS AND PORTABILITY
You have the right to request certain copies of your personal information held by us. In certain instances, you also have the right to request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format and/or request us to transmit this information to another service provider (where technically feasible).
RECTIFICATION
You have the right to ask us to correct inaccurate or incomplete personal information about you (and which you cannot update yourself within your moonpark account).
ERASURE
We generally retain your personal information for as long as is necessary for the performance of the agreement between you and us, to comply with our legal obligations, and as permitted by applicable law.
You have the right to ask us to delete your personal information, subject to certain limitations and restrictions. Please note that if you request the erasure of your personal information:
- We may retain your personal information as necessary for our legitimate business interests, such as prevention of money laundering, fraud detection, and prevention and enhancing safety. For example, if we suspend a moonpark account for fraud or safety reasons, we may retain information from that account to prevent that user from opening a new moonpark account in the future.
- We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, moonpark may keep your information for tax, legal reporting, and auditing obligations.
- Information you have shared with others (e.g., reviews) will continue to be publicly visible on moonpark, even after your moonpark account is canceled. However, attribution of such information to you will be removed.
- Some copies of your information (e.g., log records) will remain in our database but are disassociated from personal identifiers.
- Because we maintain moonpark to protect from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period of time.
WITHDRAWING CONSENT
If we are processing your personal information based on your consent you can withdraw your consent at any time by changing your account settings or by sending a communication to moonpark specifying which consent you are withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal.
RESTRICTION OF PROCESSING
You have the right to limit the ways in which we use your personal information, in particular, where (i) you contest the accuracy of your personal information; (ii) the processing is unlawful and you oppose the erasure of your personal information; (iii) we no longer need your personal information for the purposes of the processing, but you require the personal information for the establishment, exercise or defense of legal claims; or (iv) you have objected to the processing and pending the verification whether the legitimate grounds of moonpark override your own.
OBJECTION TO PROCESSING
You have the right to object to the processing of your personal information based on grounds specific to your situation if such processing is for direct marketing or is for a purpose based on legitimate interest or public interest. If you object to processing based on legitimate or public interests we will no longer process your personal information for these purposes unless we can demonstrate compelling legitimate grounds for such processing or where the processing is otherwise required for the establishment, exercise, or defense of legal claims.
Where your personal information is processed for direct marketing purposes, you may, at any time, ask moonpark to cease processing your data for these direct marketing purposes by sending an email to hello@moonpark.haus.
LODGING COMPLAINTS
You have the right to lodge complaints about our data processing activities by filing a complaint with moonpark or with a supervisory authority.
RETENTION
We retain personal information for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law. The criteria used to determine our retention periods include:
- the length of time we have an ongoing relationship with you and provide moonpark to you (for example, for as long as you have an account with us or keep using moonpark);
- whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); and/or
- whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).
OPERATING GLOBALLY & INTERNATIONAL TRANSFERS
To facilitate our global operations, moonpark may transfer, store, and process your information with our affiliates, partners, and service providers based in Europe, India, Asia Pacific, and North and South America. Laws in these countries may differ from the laws applicable to your country of residence. In certain circumstances, courts, law enforcement agencies, regulatory agencies, or security authorities in these other countries may be entitled to access your personal information.
11. California and Vermont Supplement
If you reside in California or Vermont this section applies to you and supplements the moonpark Privacy Policy.
CALIFORNIA AND VERMONT RESIDENTS
Moonpark will not share information it collects about you with its affiliates or third parties (both financial and non-financial), except as required or permitted by your state’s law.
CALIFORNIA PRIVACY RIGHTS
California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those third parties. Moonpark does not share personal information with third parties for their own direct marketing purposes without your prior consent. Accordingly, you can prevent the disclosure of your personal information to third parties for their direct marketing purposes by withholding consent.
Effective January 1, 2020, the California Consumer Privacy Act (CCPA) allows California residents, upon a verifiable consumer request, to request that a business that collects consumers’ personal information to give consumers access, in a portable and (if technically feasible) readily usable form, to the specific pieces and categories of personal information that the business has collected about the consumer, the categories of sources for that information, the business or commercial purposes for collecting the information, and the categories of third parties with which the information was shared. For more information about how we collect, use, and disclose personal information for business purposes, please review our Privacy Policy. California residents also have the right to submit a request for deletion of information under certain circumstances. Consistent with California law, if you choose to exercise your rights, we won’t charge you different prices or provide different quality of services unless those differences are related to your information. Please note that you must verify your identity and request before further action is taken. As a part of this process, government identification may be required. Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requestor’s valid government-issued identification, and the authorized agent’s valid government-issued identification.
We do not sell personal information to third parties. We do allow third parties to collect personal information through the moonpark platform and share personal information with third parties for the business purposes described in the Privacy Policy, including without limitation advertising and marketing on the moonpark platform and elsewhere based on users’ online activities over time and across moonpark, services, and devices.
